Sexual Harassment in the Restaurant Industry

1. Take Immediate Action
If you are sexually harassed in a restaurant—either verbally or physically—the most important thing is not to remain silent. Speak up. If it’s verbal harassment, say something like, “Please don’t speak to me that way” or “That’s not appropriate.” If it’s physical contact, firmly state, “Keep your hands to yourself” or “Do not touch me like that.”
If the situation escalates, remove yourself from the environment. If you’re in a restaurant, notify a server or manager immediately. If you’re unsafe, leave the premises and call for assistance.
2. Know Your Rights as a Customer
Even as a guest or patron, you have rights. Many states, including New York and California, have civil codes that obligate restaurant owners and employees to ensure a safe, respectful, and harassment-free environment for customers.
For example, under California Civil Code Sections 54 & 55, restaurant staff must offer reasonable accommodations when requested, such as seating adjustments if another guest is harassing you. Refusal to act on such requests may be a legal violation.
3. What to Do If You’re Sexually Assaulted
If you’ve experienced unwanted physical contact that escalates into sexual assault, your safety and health come first. Seek immediate medical care. Let hospital staff know what happened so they can collect necessary evidence.
A rape kit should be completed within 96 hours for the best chance of preserving DNA and other forensic evidence. You do not have to decide about pressing charges immediately, but evidence collection is essential if you choose to pursue a case later.
4. Follow Up and Document the Incident
Once you’re safe, follow up with the restaurant’s management or ownership. Request an in-person meeting if possible, and detail what occurred. Ask what actions are being taken to address the incident and prevent it from happening again.
Be sure to document everything. This may include:
- Receipts and dated proof of your visit
- Credit card records or online orders
- Emails or texts exchanged with the restaurant
- Witness statements, if applicable
- Screenshots of any online or social media messages related to the incident
This documentation will be useful if you choose to pursue legal action through civil court.
5. Speak with an Attorney
